In making that determination the attorney must decide whether the accident was the result of an unreasonably hazardous condition that the owner knew or should have known of and failed to remedy. If the owner was at fault, the next question the attorney must answer is whether the injury was severe enough to make a law suit financially feasible. If the injury is relatively minor, a lawsuit may not be a practical course of action even if the landowner was negligent in causing it.
The evidence is critical when compiling a slip and fall case. At the time of the accident, both the victim and the business or property owner should fill out an accident report describing the accident and circumstances, and also listing anyone who witnessed the accident. Any existing surveillance tape should be secured as soon as possible, so it will not be discarded or recorded over.
