The Slip & Fall Cases

Slipping or tripping may sound like an innocuous accident, but ask slip and fall lawyers and they will tell you about some of the serious cases they have encountered. While some accidents cannot be avoided, many falls are the result of unsafe conditions arising from negligence, and those responsible may be liable for any resulting injuries.

A slip and fall suit is not always the solution to an injury sustained in the workplace. More often than not, companies cover injuries suffered by their employees through workers’ compensation insurance. In such cases, issues regarding compensation are determined through a workers’ compensation claim rather than a personal injury lawsuit. However, if the accident occurred in a non-work setting there may be a case for compensation, depending on the cause of the injury and its severity.

Compensable slip and fall cases must meet certain key requirements. The most important question, of course, is whether the property owner is responsible for the accident, something your lawyer will assess with you upon review of your case. In making that determination the attorney must decide whether the accident was the result of an unreasonably hazardous condition that the owner knew or should have known of and failed to remedy. If the owner was at fault, the next question the attorney must answer is whether the injury was severe enough to make a law suit financially feasible. If the injury is relatively minor, a lawsuit may not be a practical course of action even if the landowner was negligent in causing it.

The evidence is critical when compiling a slip and fall case. At the time of the accident, both the victim and the business or property owner should fill out an accident report describing the accident and circumstances, and also listing anyone who witnessed the accident. Any existing surveillance tape should be secured as soon as possible, so it will not be discarded or recorded over. If you are carrying a smart phone, it would be prudent to take pictures of the scene and any substance on the floor or condition that you feel caused the accident.
